Model State Code of Military Justice (2011)

In 2011, the American Bar Association (ABA) again proposed a Model State Code of Military Justice for States to adopt.  The 2003 ABA model was first approved by the Department of Defense in 2005 after which at least six states adopted it.  The Model State Code would provide a more effective disciplinary tool for commanders, more consistent application of such discipline from one state to another, and facilitate Total Force Integration and inter-operability when transtioning from Federal Title 32 (State Guard) Federal Title 10 (active duty military) status.  The Model State Code focused on military offenses as civilian criminal prosecution is possible under Article 134 (General Article), which includes 54 offenses (such as: robbery, arson, or murder).
